How can this model be applied in the context of analyzing cross-border labor solidarity campaigns? Despite Keck and Sikkink’s puzzling comments about “transitory nature” of labor-oriented TANs,143 I contend that their conceptual model is, for the most part, very useful. In the Kukdong case, the workers realized that they had very little, if any, leverage over their two immediate “targets”—Kukdong and the CROC. After the three-day strike was violently repressed, the workers contacted the WRC. Soon thereafter, the WRC conducted its initial investigation.

Finally, on August 14, 1997, after an eight-year struggle, union members ratified the only contract that existed, at that time, in the entire Guatemalan maquiladora industry. This was a remarkable victory for the PVH workers. The PVH campaign was widely hailed within the anti-sweatshop movement because it showed that garment workers and social justice activists could fight back and win. 3 Fifteen months after the contract was signed, however, PVH closed down its unionized factory on December 11, 1998.

The Guatemalan Labor Ministry was concerned, moreover, that unionization and the negotiation of a collective bargaining agreement could scare away foreign investors. It, therefore, took PVH’s side. These machinations, much to the company and government’s chagrin, did not derail the campaign. The PVH workers continued to hold actions inside and outside the factory. Meanwhile, social justice activists from labor, student, solidarity, and faith-based organizations in Canada and the United States continued passing out leaflets.
